THE PROBLEM OF LAND LITIGATION IN GHANA: IS LAND TITLE REGISTRATION ENOUGH?

- If the person who conveys property to another has no title (i.e. the seller did not have ownership of the land and therefore could not sell same), registration by the purported buyer at the Land Title Registry, cannot confer title on that buyer. If the transaction is void as regards to title, it will still remain void even after registration.
- If there are two buyers of the same piece of land and they both buy from the same legitimate owner, and both of them have not entered (possessed) the land, the buyer who registers his title first gains priority of interest in the land, irrespective of when he bought the land.
- Where the parties derive their titles from different grantors, registration is of no consequences and the court will not neglect its duty to ascertain who has valid title, by way of possession or otherwise.
- Where a person who has not registered his interest in a land, is nevertheless in possession of same i.e. if he has built or planted on the land, any person who registers a contrary interest in that land, acquires no superior title as such a person will be fixed with knowledge of the first person’s acts of possession of the land.
